No. 94-332, supra, p. 4. The following year produced the study on education for all children with disabilities Act of 1975.

In order to qualify for federal financial assistance under the Act, the State must prove that “a policy that ensures all children with disabilities the right to a free appropriate public education.” 20 USC 1412 (a). The “free appropriate public education” required by the Act is adapted to the unique needs of children with disabilities through a program “Individualized Education” (IEP). In addition to the State Plan and the IEP already described, the law imposes many requirements of the procedure in the state receiving federal funds under the provisions. Parents or guardians of children with disabilities must be notified of any proposed changes in “the identification, evaluation or educational placement of the child or the provision of free appropriate public education to the child “and should allow a complaint about” any matter relating to “such evaluation and education. 1415 (b) (1) (D) and (E) 0.6 complaints from parents or guardians must be resolved to “an impartial due process” and called on the State educational agency shall be provided, if the initial hearing is held locally or regionally. requested services Alamo Heights ISD was for Steven.

For seven years prior to 1980, the Alamo Heights School District offered a summer program for special education students who are moderately or severely disabled. The decision to offer the program was at the administrative level, as a matter of district policy, and all moderately to severely disabled child was ineligible for

attend. In the summer of 1980, when Steven would have been eligible for this program, however, the school district changed its policy and offered a half day per month of the program provide transportation. The decision to reduce the summer program is based on its cost and the apparent lack of interest by teachers and eligible students in previous years.

No student in the class of Steven multiply handicapped program used was 1980, not Steven. It is not clear, however, if Mrs. G. was not informed about the program or lack of transport and the hours they did not participate in Steven. During that summer, Steven stayed with a babysitter who had no training in special education. There was testimony that Steven’s behavior deteriorated in the summer and suffered a setback in its ability to support, time and food.

The following year request of Mrs. G. services for the summer and transport was rejected by the school authorities without Steven admissions consultation, review and dismissal (ARD) or your teacher. The sole guardian of Mrs. G. could find for Steven lived a mile outside the boundaries of the district, and even during the school year, the school district does not
